Terms of Service

These Terms of Service govern your access to and use of OpenPostern, including our website, application, and APIs. Please read them carefully.

Acceptance

By creating an account or using OpenPostern in any way, you agree to be bound by these Terms of Service ("Terms"). If you are using the service on behalf of a company, you represent that you have the authority to bind that company to these Terms.

If you do not agree to these Terms, do not use the service.

The service

OpenPostern provides vendor risk monitoring and breach alerting for small businesses. We aggregate publicly available information including CVE databases, breach disclosures, dark web sources, and compliance records to produce risk scores and alerts.

We do not guarantee that our monitoring is exhaustive or that all breaches or vulnerabilities will be detected. Risk scores are informational and not a substitute for a formal security assessment.

Account terms

You must provide accurate account information and keep it up to date. You are responsible for all activity that occurs under your account.

You must be at least 18 years old and legally permitted to enter into contracts in your jurisdiction.

Scout (free) accounts are limited to 5 vendors. Paid plans include unlimited vendor slots as described on the pricing page. Limits are enforced automatically.

Payment and billing

Paid plans are billed monthly or annually in advance. All fees are in USD and non-refundable except as described in our refund policy.

We offer a 30-day free trial on all paid plans. No credit card is required to start a trial. If you do not cancel before the trial ends, you will be charged for the first billing period.

We may change pricing with 30 days notice. Price changes will not apply to your current billing period.

Acceptable use

You may not use the service to monitor vendors without a legitimate business relationship, or to build competing products, or to harvest data at scale via automated means.

You may not attempt to reverse-engineer, decompile, or otherwise extract the source code of the service.

You may not use the service in any way that violates applicable law or the rights of third parties.

Your data

You own your data. We do not claim any rights to vendor lists or other content you submit.

You grant us a limited license to process your data for the purpose of providing and improving the service.

Termination

You may cancel your account at any time from the account settings page. Cancellation takes effect at the end of your current billing period.

We may suspend or terminate your account immediately if you violate these Terms, fail to pay, or engage in fraudulent activity.

Upon termination, your data is deleted in accordance with the retention schedule in our Privacy Policy.

Limitation of liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

IN NO EVENT SHALL OPENPOSTERN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.

Changes to these terms

We will notify you by email at least 14 days before making material changes to these Terms. Continued use of the service after the effective date constitutes acceptance of the new Terms.
